This Privacy Statement and its enumerated policies are intended to comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the “General Data Protection Regulation” or “GDPR”) and provide appropriate protection and care with respect to the treatment of your user information in accordance with the GDPR. Protecting your private information is our priority. This Statement of Privacy applies to atlasdigitalsignage.com and Atlas, Inc. and governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to Atlas, Inc. include atlasdigitalsignage.com, Atlas mobile app, and Atlas. The Atlas website is an In-store Digital Signage & Marketing Technology site. By using the Atlas website, products, and app, you consent to the data practices described in this statement.
Collection of Your Personal Information
In order to better provide you with products and services offered on our Site, Atlas may collect personally identifiable information, such as your:
- First and Last Name.
- Mailing Address
- E-mail Address
- Phone Number.
- Device Information
- Contact List Information
- Location
We may also collect information about you in the following ways:
Contact Information
We may collect the names and usernames of our customers and other visitors. Additionally, we may collect information regarding your physical addresses, phone numbers, email addresses, and other digital contact information. We may also collect information that you provide us about others.
Contact List Information
While using the Atlas mobile app, we may request permission to access your contact list information. This is to allow you to easily and quickly invite employees to manage and access the app directly from your contacts list.
Demographic Information
We may collect information about products or services you like, reviews you submit, or where you shop. We might also collect information like your physical address, age, gender, marital status, profession, income, and other data related to a natural person. We may collect some of this information from other sources. For example, we may get information about you from third-party business partners or from a friend who purchases something for us to send to you.
Location Information
If you use our mobile services, we may collect location data obtained from your mobile device's GPS. If you use our websites or our mobile application, we may collect location data obtained from your IP address. We may use this location information on the Atlas mobile app to provide more tailored price recommendations and product optimizations, such as comparing the price of your products against the average price of the same item in your area.
Other Information
If you use our websites, we may collect information about the browser you are using. We might track the pages you visit, look at what website you came from, or what website you visit when you leave us. We collect this information using the tracking tools described in the Tracking Tools section at the bottom of this page. To control those tools, please read the Your Privacy Preferences section.
We collect information from you passively.
We may use tracking tools like browser cookies, flash cookies, and web beacons.
Contests, Questions, or Surveys
When you ask a question, participate in a survey, or enter a contest or sweepstakes, we may collect your name, address, phone number, and email address. We may use this information to facilitate your participation in a contest or sweepstakes. At that time, we may ask your permission to send you future marketing information.
To enhance, personalize, and support your experience on the Site, among other things, we collect, use, and share your user information. For example, we may use aggregated information to develop content targeted to user interests and to generally improve the Site's user experience. As detailed below, your user information may also be used by Atlas and its partners to tailor content and ads, provide social media features (e.g., features that allow you to share content directly to your preferred social media platform), track your preferences, analyze traffic, and provide similar services and content. Atlas is committed to your privacy and will not share any user information with any third party without your consent, except as outlined in this Privacy Statement or as permitted by law. If you have any requests, comments, problems, or questions about this Privacy Statement or your user information, please contact us in the manner provided at the end of this document.
Atlas is your contractual partner and controller of your personal data in accordance with Art. 4 para. 7 General Data Protection Regulation (“GDPR”) concerning the entering into and administering the contractual relationship with you. For information on data processing in relation to your responsible use of the functionalities of the Software as well as the Server Services as described in the EULA, please refer to the information concerning the use of Atlas.
Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through Atlas's public message boards, this information may be collected and used by others.
When you sign up to Atlas, we use your personal data for the administration and enhancement of the contract with you. Legal basis to process your personal data outlined under C. II. is Art. 6 para. 1 lit. b) GDPR.
We do not collect any personal information about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain products or services available on the Site. These may include:
- Registering for an account on our Site;
- Entering a sweepstakes or contest sponsored by us or one of our partners;
- Signing up for special offers from selected third parties;
- Sending us an email message;
- Submitting your credit card or other payment information when ordering and purchasing products and services on our Site.
We may use your information for, but not limited to, communicating with you in relation to services and/or products you have requested from us. We also may gather additional personal or non-personal information in the future.
Use of Your Personal Information
Atlas collects and uses your personal information to operate its website(s) and deliver the services you have requested. Atlas may also use your personally identifiable information to inform you of other products or services available from Atlas and its affiliates. Atlas is using information about the frequency of your use of Atlas in order to monitor if the agreed license restrictions are observed, and in case we recognize that they are exceeded, we will contact you to suggest changing your license type. Legal basis for processing your personal data outlined under C. III is Art. 6 para. 1 lit. b) GDPR.
Atlas may use your information to protect our company, our customers, or our websites if we suspect fraud or other illegal activities or if there is an investigation relating to the same. Atlas may use your information for our marketing. In certain circumstances, we may target you with digital ads, social ads, print ads, and other communications about special promotions, offers, or rewards. For example, if you have registered on a website and indicated you want to receive this information. We may also notify you of new website features or product and service offerings.
Atlas may use your information to communicate with you about your account or our relationship. We may contact you to tell you about changes to this Privacy Policy, the Terms of Use of our websites or mobile services, or changes to any of our programs in which you might be enrolled. We may also tell you about issues with your orders or if there is a product recall.
If you place an inquiry with Atlas by using the in-product feedback feature, we need to process your personal data in order to answer your request. Legal basis for processing your personal data outlined under C. IV is Art. 6 para. 1 lit. b) GDPR. If you sign up for Atlas's promotional email subscription, we process your personal data in order to send you the newsletter. Legal basis to provide you with the newsletter is your consent according to Art. 6 para. 1 lit. a) GDPR, which you may revoke at any time with effect for the future. In case you have a paid subscription, we may use your email address to send you information on similar products and services. Legal basis is Art. 6 para. 1 lit. b) GDPR, sec. 7 para. 3 Unfair Competition Act (“UWG”).
When you use Atlas and pay a subscription fee, we additionally collect information to support payment processing, which includes a payment token provided by our Payment Service Provider to identify the transaction. Legal basis for processing your personal data outlined under C. IV is Art. 6 para. 1 lit. b) GDPR. Where it is necessary for compliance with a legal or regulatory obligation that we are subject to, we process your personal data according to Art. 6 para. 1 lit. e) GDPR.
Call Centers
When you contact our Call Center, you may be asked for information that identifies you, along with additional information we need to help us promptly answer your questions or concerns. This may include your name, address, and a phone number where we can reach you. We may keep this information to assist you in the future.
Online Registration
Registration on any of our websites or for any of our programs is an optional service. When you register, you are asked for personal information such as your name, physical address, phone number, email address, a password that you select, and optionally, your interests. When you register, you will also have the opportunity to sign up for future marketing information from Atlas.
Passwords
If you choose to register on our websites or for any of our programs, you will be asked to create a username and password. In order to further protect your personal information, please do not share your password with anyone else. If you wish to cancel a password, or if you become aware of any loss, theft, or unauthorized use of your password, please contact us in the manner provided at the end of this document.
No “Phishing” Allowed
We will never request your password, username, credit card information, or other personal data through email. This practice, called “phishing,” is a scam designed to steal your personal information. If you receive an email that looks like it is from Atlas requesting this type of personal information, please delete it.
Privacy Preferences / Opt-Out
As a registered user, you may request to see the personal information that we have about you. To access your profile information at any time, sign in/log in to your account. If you want to exercise your right to have your personal data deleted, you can do it using the following link.
How to Unsubscribe
From email marketing communications, please select the 'Unsubscribe' link located at the bottom of that particular email message. Although you may have opted not to receive marketing communications, you may still get order confirmations, product recall notices, or other order-related communications.
Cookies
A cookie is a small data file that is written to your computer's hard drive by your web browser. A cookie file can contain and/or automatically collect information, such as a user identification code or IP address, that a website will use to track the pages and number of times you have visited. The data read from these cookies may be linked to personally identifying (PII) and non-personally identifying (non-PII) information.
Essential Cookies
Certain cookies are used for specific purposes that are essential to your secure use and navigation of the Site. Without them, Atlas may not be able to provide core Site functions and features to you, and the Site would not operate as well as you or Atlas would like. These cookies collect and use information such as your server preferences, single-session data and corresponding identifier, web beacons and log files (detailed below), and other credential-related information. For EU individuals, essential cookies also help inform Atlas whether you require, or have already been served, an affirmative consent request in connection with the GDPR. Essential cookies include analytics cookies, which provide us data that allows Atlas to better understand its users and improve the Site based on what we have learned from that data.
Sharing Information with Third Parties
Atlas does not sell, rent, or lease its customer lists to third parties.
We may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to Atlas, and they are required to maintain the confidentiality of your information.
Atlas may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to:
- Conform to the edicts of the law or comply with legal process served on Atlas or the site;
- Protect and defend the rights or property of Atlas; and/or
- Act under exigent circumstances to protect the personal safety of users of Atlas, or the public.
Information About Others
In order to process and/or deliver your order, we may share information with participating retail stores and other third parties who require it. To ship the order and confirm delivery:
- To identify or resolve technical problems or Customer Service issues
- As required by law and to comply with a court order or other legal process
- To respond to claims that your personalized messages violate the rights of third parties
- To protect the rights or property of Atlas and its affiliates
Controlling Online Interest-Based Ads
We sometimes work with online advertising vendors to provide you with relevant and useful ads. This may include ads served on our websites or mobile services. This may also include ads served on other companies' websites. These ads may be based on information collected by us or third parties. For example, information a third party collects when you register for a website, like your zip code. This might be used to target an ad for people in your area. These ads may also be based on your activities on our websites or on third-party websites.
Information Sharing
We sometimes share information with third parties who perform services on our behalf. We share information with our service providers, such as our delivery service providers who ship and deliver your online orders. We might also authorize our service providers to collect information on our behalf. Some service providers may be located outside of the United States. We might also share information with the vendors and manufacturers of our products and services to respond to your reviews and questions. We may also share information with third parties that provide support services to us (such as a printer, mailing house, or web host) or that help us market our products and services. Such third parties may need information about you in order to perform their functions.
Children Under Thirteen
Atlas does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this website.
Disconnecting Your Atlas Account from Third-Party Websites
You will be able to connect your Atlas account to third-party accounts. BY CONNECTING YOUR ATLAS ACCOUNT TO YOUR THIRD-PARTY ACCOUNT, YOU ACKNOWLEDGE AND AGREE THAT YOU ARE CONSENTING TO THE CONTINUOUS RELEASE OF INFORMATION ABOUT YOU TO OTHERS (IN ACCORDANCE WITH YOUR PRIVACY SETTINGS ON THOSE THIRD-PARTY SITES). IF YOU DO NOT WANT INFORMATION ABOUT YOU, INCLUDING PERSONALLY IDENTIFYING INFORMATION, TO BE SHARED IN THIS MANNER, DO NOT USE THIS FEATURE. You may disconnect your account from a third-party account at any time. Users can easily delete third-party integrations by signing into their account and visiting the respective feature page.
External Data Storage Sites
We may store your data on servers provided by third-party hosting vendors with whom we have contracted.
Changes to This Statement
Atlas reserves the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our site, and/or by updating any privacy information on this page. Your continued use of the Site and/or services available through this Site after such modifications will constitute your:
- Acknowledgment of the modified Privacy Policy; and
- Agreement to abide and be bound by that Policy.
How Will I Know if the Privacy Statement Is Changed?
If we make any material changes, we will notify you by email if legally required (sent to the email address specified in your account) or by means of a notice on this website prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices.
Breach Notification
It is impossible for Atlas to completely guarantee that user data will be immune from malicious attack or compromise; as such, users should understand that their transmission of personal data is at their own risk. However, in the event of data breaches or compromise, Atlas strives to follow the protocol outlined below, which may differ under various circumstances:
It is Atlas's policy to be fair and proportionate when considering the actions to be taken to inform affected parties regarding breaches of personal data. In line with the GDPR, where a breach is known to have occurred which is likely to result in a risk to the rights and freedoms of individuals, the relevant supervisory authority will be informed within 72 hours. Under the GDPR, the relevant Data Protection Authority has the authority to impose a range of fines of up to four percent of annual worldwide turnover or twenty million dollars, whichever is higher, for infringements of the regulations.
California Residents
This privacy notice for California residents supplements the information contained in the Atlas Privacy Policy and applies solely to visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and other California privacy laws.
Information We Collect
We may collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“personal information”). In particular, we have collected the following categories of personal information from consumers within the last twelve (12) months:
Personal information does not include:
- Publicly available information from government records.
- De-identified or aggregated consumer information.
